Richard L Marcus, Martin H Redish, Edward F Sherman, James E. Pfander
R9,119 Discovery Miles 91 190 Ships in 12 - 17 working days

Since it first appeared, this casebook has sought to capture the evolving challenges of civil procedure in a way that engages students and fosters critical judgment on the underlying policy issues. The authors have closely monitored the evolution of procedure over this time, and adapted the basic structure of the book to take account of those changes. That evolution remains central to the seventh edition. The new edition retains the basic structure of the book, and a great deal of the existing superstructure of principal cases. It adds substantially revised text and note material to present contemporary issues in the context of those cases or new principal cases. The discovery chapter, for example, is infused with coverage of the 2015 rule amendments that have received somuch attention. The personal jurisdiction chapter integrates the many recent Supreme Court decisions into the existing framework, conveying the developments that have occurred since the last edition appeared in 2013. The new edition also offers new principal cases to examine and illustrate a number of issues. A new Rule 19 case on required parties presents the contemporary issues in a setting likely to be interesting to many students. A new Internet jurisdiction case involves online payday lending, an example of the fast-moving world of Internet-based commerce. A recent supplemental jurisdiction case enables students to work through the application of 1367 in a setting that also involves appreciation of various joinder concepts. A new class-action case presents the challenges of consumer class actions. New Supreme Court and other principal cases address issues of subject matter jurisdiction and appellate jurisdiction. As reflects contemporary litigation, intellectual property cases are more prominent than in previous editions.

The topics discussed in this law-school study outline include territorial (personal) jurisdiction (including venue and forum non conveniens) and subject-matter jurisdiction (covering diversity jurisdiction, federal-question jurisdiction, removal and supplemental jurisdiction). The Summary provides an accessible explanation of the Erie doctrine and federal common law. It introduces contemporary doctrine on pleadings (including counterclaims, crossclaims, amendments and supplemental pleadings) and joinder of parties (including joinder and class actions). Coverage also includes discovery (including the 2015 rule amendments regarding devices, scope, sanctions and discovery conferences). There is a full chapter addressing summary judgment. Another chapter covers pretrial conferences, settlement-promotion devices, and the increasingly important topic of arbitration. The trial chapter covers the right to jury trial, trial motions, jury instruction and arguments, and post-verdict motions. There are also chapters on appeals and preclusion (both claim and issue preclusion). The Summary begins with an extensive Capsule Summary of all the topics covered, and also includes Review Questions keyed to the outline's coverage, and sample essay questions and answers. Throughout the outline, there are also Exam Tips and charts to summarize and explain the material.

Richard L Marcus, Edward F Sherman, Howard M. Erichson, Andrew D. Bradt
R8,275 Discovery Miles 82 750 Ships in 12 - 17 working days

Hardbound - New, hardbound print book. Since 1985, this casebook has been the staple of Complex Litigation courses. It covers a wide variety of cases - civil rights, mass torts, securities, consumer rights - and provides a strong foundation for classroom coverage regarding any type of complex litigation. The new 7th edition retains the book's familiar broad coverage and basic format while adding coverage of important recent developments. In particular, the new edition has a full chapter devoted to Mutidistrict Litigation, which is increasingly prominent, and new cases interpreting the 2018 Rule 23 amendments. In addition, it includes new cases dealing with contemporary problems in e-discovery as well as the growing use of plaintiff fact sheets in MDL mass tort proceedings. The new edition also introduces a new co-author - Prof. Andrew Bradt of UC Berkeley, a leading scholar on MDL issues. The final chapter on arbitration has been reoriented to focus on ways in which arbitration clauses may keep some complex litigation - particularly class litigation - out of court.
